This Rental Agreement (“Agreement”) is made between Adventure Campers Ltd (“the Owner”) and the person(s) named in the booking confirmation (“the Hirer”). By confirming a booking online or signing this Agreement digitally, the Hirer agrees to all terms and conditions contained herein.
1. Definitions and Agreement
“Vehicle” means the campervan and all accessories, tools, and equipment supplied by the Owner.
“Hirer” means the person or persons named on the rental agreement or booking confirmation.
The Hirer agrees to use the Vehicle in accordance with the terms of this Agreement.
2. Vehicle Condition and Inspection
A pre-hire inspection will be completed before the handover. The photos will be available to the hirer through our online system. Any existing damage will be noted.
The Hirer must notify the Owner of any new damage or mechanical issues immediately.
The Vehicle must be returned in the same condition as when hired, subject to fair wear and tear.
3. Vehicle Use Restrictions
The Vehicle must not be driven in these terrains or situations:
- For off-road activities
- On beaches
- On sand
- On snow without appropriate snow chains or snow tyres.
- Through rivers, lakes, stream or flood water
- On unsealed roads except to access recognized campgrounds.
- The Vehicle may not be used for racing, towing, or illegal purposes.
The Hirer must comply with all New Zealand road laws.
4. Insurance, Damage & Liability
4.1 Insurance Cover Provided
Adventure Campers Ltd (“the Owner”) provides motor vehicle insurance for all vehicles in accordance with New Zealand law. This insurance covers:
- Third-party property damage (liability to other vehicles or property).
- Damage to the rental vehicle, subject to exclusions below.
- Theft, fire, and vandalism, subject to exclusions and excess.
This cover is valid only when the Hirer and any approved drivers comply with this Rental Agreement and the conditions of the insurance policy.
4.2 Hirer’s Responsibility and Standard Excess
The Hirer is responsible for any loss or damage to the vehicle or third-party property up to the amount of the insurance excess, also known as the liability limit.
- Standard Excess: NZD $2,500 per incident.
- The excess applies to each separate event (e.g. collision, theft, windscreen damage).
- The excess will be charged immediately after an incident, and adjusted later if costs are lower.
- The Hirer remains responsible for damage not covered by insurance (see exclusions below).
4.3 Optional Cover Packages
To reduce the Hirer’s financial liability, Adventure Campers offers the following optional insurance packages. The Hirer may choose one at the start of the rental period.
(a) Basic Cover — Included with all rentals
- Standard excess of $2,500 applies.
- Covers collision, theft, fire, and third-party property damage.
- Excludes windscreen, tyre, and underbody damage.
(b) Explorer Cover — $25 per day
- Reduces excess to $750.
- Includes windscreen and tyre damage cover.
- Covers single-vehicle accidents and minor exterior damage.
- Includes towing costs (within NZ) after an insured accident.
(c) Adventure Plus Cover — $35 per day
- Reduces excess to $0 (nil liability).
- Includes windscreen, tyre, roof, and underbody cover.
- Includes roadside assistance, towing and replacement vehicle (subject to availability).
- Covers accidental damage to accessories supplied by Adventure Campers (e.g. outdoor table, chairs, GPS).
These packages do not cover damage or loss caused by excluded uses or breaches of this agreement.
4.4 Exclusions (Not Covered by Any Package)
Insurance and optional cover will be void if the vehicle is used in breach of this agreement, including but not limited to:
- Driving off-road, on beaches, riverbeds, unsealed or restricted roads.
- Driving under the influence of alcohol, drugs, or while fatigued.
- Damage caused by unlawful driving.
- Damage caused by ignoring warning lights that appear on the dashboard.
- Operation by an unlicensed or unapproved driver who is not listed on the agreement..
- Carrying passengers or goods for hire or reward.
- Failing to secure the vehicle or report loss/damage promptly.
- Damage caused by using the wrong fuel or overloading.
- Loss or damage to personal belongings inside the vehicle.
If any of these occur, the Hirer is liable for all repair and recovery costs, regardless of insurance.
4.5 External Insurance
In accordance with the Land Transport Rule: Operator Licensing 2017, the Hirer may choose to provide their own insurance in place of the Owner’s cover. The Hirer must provide written proof of comparable vehicle insurance before the rental commences. Adventure Campers reserves the right to decline hire if the alternative cover is not satisfactory.
4.6 Claims, Accidents & Reporting
The Hirer must notify Adventure Campers immediately of any accident, theft, or damage, and provide a written report within 24 hours.
- If another party is involved, the Hirer must obtain their name, address, and vehicle details.
- Police must be notified for any injury, theft, or third-party property damage.
- Failure to comply with these requirements may void the insurance cover.
4.7 Insurance Provider
Adventure Campers Ltd maintains fleet insurance with a licensed insurer under the Insurance (Prudential Supervision) Act 2010, specifically covering vehicles operated as part of a registered rental-service business in New Zealand.
5. Rates, Payments and Security Bond
All bookings made online must be paid in full at the time of booking.
A refundable security bond between NZD $500 and NZD $2,500 (depending on insurance cover) is required.
Payments may be made by credit card or other accepted methods.
The bond is refunded after the Vehicle is returned undamaged, and with a full tank of fuel.
6. Cancellations and Refunds
Cancellations are subject to the following refund policy:
• 100% refund if cancelled at least 3 days before the pick-up date.
• 50% refund if cancelled 1–2 days before the pick-up date.
• No refund if cancelled on the day of vehicle pick-up.
7. Drivers and Licence Requirements
The minimum driver age is 20 years. Drivers must hold a full and valid New Zealand or international driver’s licence.
Additional drivers are permitted on the same terms.
All drivers must be named on the rental agreement.
8. Insurance and Liability
Comprehensive vehicle insurance is included. The standard excess is NZD $2,500 per incident.
Optional excess-reduction cover may be purchased.
The Hirer is liable for all damage not covered by insurance, including overhead, underbody, or water damage, and any excluded use.
9. Prohibited Use
The Hirer must not:
• Drive off-road or on unsealed tracks (except to access recognized campgrounds).
• Drive on beaches, through rivers or floodwaters.
• Smoke or allow animals inside the Vehicle.
• Operate the Vehicle under the influence of alcohol, drugs, or medication.
10. Vehicle Return and Condition
The Vehicle must be returned reasonably clean, with a full tank of fuel, and all accessories intact.
A cleaning fee may apply if the Vehicle is excessively dirty.
Charges may apply for smoking, missing equipment, or damage to the interior, kitchen, or bedding.
11. Fuel, Mileage, Tolls and Fines
Unlimited mileage is included on all our campervans. The fuel policy is full-to-full.
The Hirer is responsible for all tolls, parking fines, traffic violations, and any associated administrative fees.
12. Additional Equipment
Optional extras are available for hire, including camping chairs, GPS units, outdoor tables, child seats, extra blankets, umbrellas, and portable fridges.
Replacement costs apply if items are lost or damaged.
13. Breakdown and Accidents
The Owner provides roadside assistance as an extra option, which you can select in your campervan booking or in the insurance options. In the event of an accident, the Hirer must notify the Owner and police immediately, obtain details of all parties involved, and complete an incident report.
14. Termination
The Owner may terminate the hire and repossess the Vehicle without notice if the Hirer breaches this Agreement, engages in unsafe use, or fails to make payment.
No refunds will be provided for early termination due to Hirer breach.
15. Indemnity and Limitation of Liability
To the extent permitted by law, the Owner’s liability is limited to the amount paid by the Hirer for the rental period.
The Owner is not liable for indirect or consequential losses, including accommodation or travel costs.
16. Privacy and Data
Adventure Campers Ltd collects personal information including driver licence details, contact, and payment information for the purpose of managing rentals and complying with legal obligations.
Information is stored securely and handled in accordance with the Privacy Act 2020.
17. Governing Law
This Agreement is governed by the laws of New Zealand. Any disputes will be subject to the exclusive jurisdiction of the New Zealand courts.
